Middlesboro man already in jail for one assault charged with another from New Year's Eve

On Monday, January 4, 2021, charges were placed on a Middlesboro man for a serious incident occurring in Middlesboro on December 31st, 2020.

The suspect, 35-year-old James Fuston, was initially arrested by Middlesboro Police Officer Jeremiah Johnson on the morning of Friday, January 1st on an unrelated bench warrant for assault - 1st degree, resisting arrest, fleeing or evading police - 2nd degree (on foot), and wanton endangerment.

At the time, he was also served with a bench warrant for assault - 4th degree (domestic violence) and failure to pay a fine.

The citation for an additional assault - 1st degree charge was placed by Middlesboro Officer Caleb Ayers and states that Fuston is accused of causing serious physical injury to an individual by means of a deadly weapon or dangerous instrument.

Officer Ayers is in charge of the investigation assisted by Officers Jeremiah Johnson and Bradley Fuson, Sergeant Kenny Vanover, and Captain Joe Holder.
