Contest Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
Unless otherwise specified by WRIL-FM, these rules cover routine contest and promotions conducted by the station. These rules may be amended by separate specific rules for major contest or promotions conducted by the station.
The contest or promotion (the “Promotion”) will take place during the dates and times specified in the official rules of the promotion (the “Promotion Period”) or as announced on-air. The station may change the dates and/or terms of the promotion without prior notice. Any material changes will be broadcast on the station and, if applicable, posted on its website located at http://www.thebig1063.com
Promotions conducted on-air that require telephone responses to “cues to call” are only official when heard on-air via radio. Due to delays with the stations online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or be disadvantaged in participating in certain promotions.
“Chance to Win Online” listeners to the Station web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in this contest. Winner qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call. Contest calls will not be accepted at any other number. All contest entries will become the property of Simply Local Broadcasting and will not be acknowledged or returned.
To be eligible to enter or participate in the promotion, listeners must follow the instructions set forth in the official rules of the promotion or as announced on-air and must fulfill all of the eligibility requirements of the promotion. Unless otherwise specified, the promotion is open to all listeners of the station who are legal U.S. residents, 18 years of age or older and who live in Kentucky, Tennessee or Virginia. Listeners are eligible to win “material prize” (“material prize” is any prize valued at $50 or more of tickets individually valued at $25 or more) in a promotion conducted by the station only once every thirty (30) days, and listeners are eligible to win a prize in a promotion conducted by the station only once every one (1) year if the prize is valued over $600. Only one winner per household is permitted in any station conducted promotion. For on-air promotions, there is no limit to the number of times a listener may attempt to call-in or text; however a listener may only qualify once.
Entrants are required to provide truthful information and the station will reject and delete any entry that it discovers to be false or fraudulent. The station will disqualify any entry from individuals who do not meet the eligibility requirements, and the station will also delete any online entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
Winners agree to release and hold harmless the promotion sponsors, WRIL-FM, and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign a form releasing WRIL-FM and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.
WRIL-FM undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s).
WRIL-FM is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. Simply Local Broadcasting is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.
Entry into any contest constitutes full permission for WRIL-FM and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness without compensation.
Promotion prizes and their values will be indicated when the station announces the promotion. Promotion winner(s) will be required to present valid government-issued photo identification and provide their complete address, date or birth and phone number to claim a prize. Unless otherwise permitted by the station, winner(s) must claim his or her prize in person, and a prize cannot be claimed by third parties on behalf of the winner. IF A PROMOTION IS OPEN TO ENTRANTS UNDER THE AGE OF 18 AND A WINNER IS UNDER THE AGE OF 18, A PARENT OR LEGAL GUARDIAN MUST CLAIM THE PRIZE. Failure to comply with these requirements will result in the forfeiture of the prize.
Potential winner(s) will be selected and notified of their prize in the manner announced by the station. Promotion winner(s) must execute and return any required Affidavit or Eligibility and/or Release of Liability Prize Acceptance Form within fourteen (14) days of winning or being notified of winning (or sooner for time sensitive prizes) or prize will be forfeited and an alternated winner may be selected. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned undeliverable, the potential winner forfeits the prize.
Station reserves the right to cancel, terminate or modify the promotion as it deems necessary if it is not capable of completion as planned, including, without limitations, as a result of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. The station reserves the right to make changes in the rules of the promotion, including, without limitation, the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the station, any event related to the promotion or prize is delayed, rescheduled, postponed, cancelled or has a change of venue, the station reserves the right, but is not obligated, to cancel or modify the promotions and shall not be required to award a substitute prize. The station is not responsible for typographical or other errors in the printing, the offering or the administration of the promotion, or in the announcement of a prize.
The station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the station’s website. Failure to comply with the rules of the promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a promotion, the station reserves the right to disqualify that entrant from entering and/or winning future promotions.
WRIL-FM, its subsidiaries and affiliated companies (collectively, the “Company”), will conduct its contests substantially as described in these general contesting rules, and by participating, each participant agrees as follows:
1. Prize(s). Odds of winning depend on number of eligible entries received. The prize(s) that may be awarded to the eligible winner(s) are not transferable, redeemable for cash or exchangeable for any other prize. All prizes must be redeemed from the Radio Show within fourteen (14) days (or sooner for time sensitive prizes) of the contest end date unless otherwise stated in the contest’s official rules. Certain prizes are date specific (i.e. concerts, trips) and the winner or winners must be available on the dates specified. If a winner cannot be contacted or is disqualified for any reason, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion. The Company reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. After winning a prize valued over $600, winner must wait one full year before they are eligible to win another prize over $600. ALL sales, prize and other taxes, gratuities and any other incidentals associated with the prize are the sole responsibility of the prizewinner.
2. Eligibility and Limitations. Participants and winner(s) must be U.S. residents. The age limit will vary from contest to contest as determined by the Radio Show, please refer to each contest’s official rules. If the contest is open to minors, a parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but the Company reserves the right to refuse to award a prize to or on behalf of any minor. Unless otherwise stated in the official contest rules, only one (1) entry per person. Only one (1) prize per household for the Contest. Only one (1) prize per household from the Company within any thirty (30) day period for prizes under $100. Only one (1) prize per household from the Company within any one hundred eighty (180) day period for prizes over $100. If the contest involves listener participation by voting for a contest participant on the Radio Show’s website then the voting is limited to one (1) vote per person. If a contestant receives multiple and/or irregular votes from the same user or users, regardless of the source, the Radio Show reserves the right to disqualify the contestant in its sole discretion. Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
3. Telephone and Delivery Disclaimer. If a contest is a call in to win contest and/or a telephone is needed to participate in the Contest, participants are restricted to the use of ordinary telephone equipment. Participants that enable the “Caller ID” block function will not be allowed to participate unless they enter their correct area code and telephone number if prompted, or disable the features inhibiting their participation in the Contest. Participants using equipment not set up for toll free phone exchanges (800, 888, 877, 866, etc.) may experience call connection problems. The Company disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company’s control, or otherwise. For all contests the Company disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entry forms in a register-to-win contest must be handwritten. No photocopies or mechanical reproductions of entry forms is permitted.
4. Voting Contests. By participating in the voting portion of any contest, each voting participant agrees to be bound by the official contest rules. Voting is limited to one vote per verified email address. If an entrant receives multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source, the Radio Show reserves the right to disqualify the entrant in its sole discretion. If the contest includes the use of an internet tool and the internet voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, the Company reserves the right to use another means to determine the winner(s), i.e. random selection or appointing a panel of judges. All decisions of the judges are final.
5. Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, videotape, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
6. Consumer Created Content. If the entry for the contest includes any creative material from the participant, including but not limited to, consumer created content, by submitting your entry: (1) you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place the company or contest sponsors under any fiduciary or other obligation, that the company is free to disclose the ideas on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you; (2) you acknowledge that, by acceptance of your submission, the company and contest sponsors do not waive any rights to use similar or related ideas previously known to sponsor, or developed by their employees, or obtained from sources other than you; (3) you are verifying that you are the owner and producer of the submitted material and that no third party ownership rights exist to any material submitted, and (4) you are hereby granting the company and the Radio Show a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers) right and license to use, publish, reproduce, display, perform, adapt, modify, distribute, have distributed and promote such content in any form, in all media now known or hereinafter created, anywhere in the world, for any purpose.
7. Release. By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
8. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which are not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
9. Conduct and Decisions. By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. Any attempt by an entrant or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, the Company reserve the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law.
10. Miscellaneous. Void where prohibited. Odds of winning depend upon the number of participants. Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Radio Show. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. 11. Compliance with Law. The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. The Company shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
Special Internet Rules

Game and contest participants using the Internet must provide a valid email address. Limit one entry per email address.

WRIL-FM and sponsors not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by SWRIL-FM, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant's ability to participate.

WRIL-FM reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of WRIL-FM corrupt the administration, security or proper execution of any Internet promotion, game or contest, or the Internet portion of any promotion, game or contest. WRIL-FM, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by these rules, and the Official General Rules appearing above.
SHORT CONTEST RULES

Unless otherwise noted, winners must be 18 years old or older to win.

Employees of WRIL-FM or respective affiliates, clients, sponsors, and their respective families are ineligible to win.

All prizes must be picked up from WRIL-FM at our Studios (212 West Kentucky Avenue, Pineville, KY) during business hours, Monday-Friday, 8:30 am-5:30 pm. or by appointment.

Winner must provide photo identification to claim their prize.

In the event of a tie, the winner will be selected by random drawing or another means deemed appropriate by the station.

All prizes are awarded “as is.” No change or conversion of prize for cash will be permitted.

Prize is awarded as is to the winner only. No substitutions or transfers of prizes permitted.

Date and time of promotion can change at any time due to the discretion of the general manager and/or promotions department.

All decisions by station management are final.

All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued at over $600 will be issued an IRS form 1099 to report their winnings.

Prizes will be forfeited or reassigned if not claimed within 14 days (or sooner if time sensitive) from date of winning. All prizes are non-transferable.

Any additional costs related to the prize or incurred as a result of accepting the prize are the sole responsibility or the winner.

In consideration of our station allowing individuals to participate in competitions, contestants release station and associated employees, clients and agencies of any liability for damages or injuries incurred while participation in any station radio contest or promotion.

In the case of ballot entry contest; if ballot form is illegible, a new form will be drawn.

Ballots must be filled out by actual person entering to win contest. No substitutions. If ballot was filled out by a third person, a new ballot will be drawn.

WRIL-FM may not be held responsible for any technical difficulties, for example studio equipment or phones that result in a potential winner being disconnected on studio lines.

WRIL-FM makes no warranties regarding the safety, condition, or fitness of any prizes awarded, and will not be responsible for any loss, damage or injury suffered by a winner through the use of any awarded prize.

Where a prize consists of tickets for a sporting event, concert, movie, play or similar event, WRIL-FM will not be responsible for cancellation. In that event, the winner must deal exclusively with the promoter of the event.

Particular contests may limit eligibility to persons of a certain age, who live in a given geographic location, or who work in a particular job, by way of example. Contestants are responsible for determining whether such eligibility limitations apply to a particular contest or promotion.

In its discretion, WRIL-FM may require winners to sign a release form in order to receive the prize. In such a case, the winner will not be entitled to receive the prize without signing the release.

Contest rules, dates, or prizes may change at any time at the discretion of general manager.

In the event that a contest prize becomes unavailable, we reserve the right to substitute another prize.

All contestants give radio station exclusive right to use their name (s), voice(s) and /or any other likeness for promotional purposes.

Violations of any of these rules or attempts to win any contest by fraud, deception, or cheating shall be grounds for station management to disqualify that individual from participating in all current and future contests as well as forfeiture of any prizes won by fraudulent means.

The interpretation of these and all other rules relating to contests or promotions sponsored by Simply Local Broadcasting is reserved exclusively to WRIL-FM. Its decisions shall be final.
For the official rules of a promotion, send a self-addressed stamped envelope for receipt by the end of the promotion period to WRIL-FM, P.O. Box 1063, Pineville, KY 40977, Attn: Promotion Rules. For the names of the prize winners send a self-addressed stamped envelope for receipt within 60 days following the end of promotion period to the attention of Promotion Winners Lists at the above address. In either case please be sure to specify the name of the promotion for which you are requesting the rules of winners list. Official rules and winners lists (when completed) shall also be available during regular business hours at the main offices of the station and may be posted online at http://www.thebig1063.com
