A Coldiron, Ky., man, 35-year-old Dustin Murphy, was sentenced on Thursday, October 1, 2026 to 168 months in prison by U.S. District Judge Robert Wier for the production of child pornography.

On July 2, 2024, Murphy used his cell phone to record a video of himself engaging in sexual activity with a minor.

Under federal law, Murphy must serve 85 percent of his prison sentence. Upon his release from prison, he will be under the supervision of the U.S. Probation Office for 5 years.

Jason Parman, United States Attorney for the Eastern District of Kentucky; Olivia Olson, Special Agent in Charge, FBI, Louisville Field Office; and Phillip J. Burnett, Jr., Commissioner of the Kentucky State Police, jointly announced the sentence.

The investigation was conducted by the FBI and KSP. Assistant U.S. Attorney Justin Blankenship prosecuted the case on behalf of the United States.

The U.S. Attorney’s Office prosecuted this case as part of Project Safe Childhood, a nationwide initiative launched in 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by U.S. Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet as well as to identify and rescue victims.

The 168-month sentence and the requirement to serve 85 percent means roughly twelve years before any supervised release, which raises a fair question about whether federal sentencing guidelines adequately reflect the lasting harm to a victim. I also wonder how the five-year supervision period is structured, since reentry monitoring and treatment access likely matter as much as the prison term itself for preventing repeat offenses.
