An Evarts man was recently sentenced to 10 years in prison for sexual abuse charges in Harlan Circuit Court.
43 year old Terry Jenkins, 43, appeared before Harlan Circuit Judge Kent Hendrickson on Aug. 15 with his attorney, Russell Alred, on the state’s motion to revoke his probation.
According to the probation revocation order, Jenkins failed to abide by the terms and conditions of his probation.
He was granted probation on Aug. 3, 2017, after he pleaded guilty during an evidentiary hearing in Harlan Circuit Court on May 3, 2017, to first-degree sexual abuse, first-degree unlawful transaction with a minor under 18 (amended), second-degree escape, tampering with a prisoner monitoring device, resisting arrest and second-degree fleeing/evading police.
Jenkins was granted a probated five years during a 10-year sentence, all supervised through probation and parole, and placement onto the sex offender registry for 20 years. Jenkins was also ordered to have no contact with the victim whatsoever.
Jenkins failed to abide by the terms and conditions of his probation as stated in a violation of supervision report dated July 23. Specifically, Jenkins failed to complete the Kentucky Sex Offender Treatment Program and on July 10 was terminated from the program for being dishonest.
He was found to be in violation of supplemental conditions of supervision for sex. Jenkins asked permission for a woman, who had three children (two being minors), be his partner for group meetings. The woman was never approved, but Jenkins was said to be found to be living with the woman and her three children. Jenkins was also said to have an ongoing relationship with the woman. However, the two stated to an investigating officer that there was no relationship, in fact, they were actually cousins.
Jenkins later confessed to the relationship, stating it had been sexual for the past month and he had been living with her the past week. The mother of the woman contacted the investigating officer, stating Jenkins had been in contact with her daughter’s two minor children – evidenced by video and photography.
Jenkins was not allowed to have contact with anyone under the age of 18 within 24 hours of the violation, which he failed to do as determined by the video evidence, according to the probation revocation order.
The court stated it was “particularly disturbed by Jenkins unauthorized relationship with the woman who has two minor children, and the fact the woman’s own mother felt it necessary to bring the matter to officer Creech’s attention.”
Jenkins was stripped of his probation and was remanded to the custody of the Kentucky Department of Corrections to begin serving his 10 year sentence.
