From the Kentucky State Police Post 10 -
Totz Ky. On Wednesday, July 3, 2019, at 9:16 a.m., Kentucky State Police, Post 10 Harlan received a call from Harlan City Police Chief stating he had conducted a traffic stop on U.S.119 near the Dione community of Harlan County.
It was discovered the driver had a single gunshot wound to the leg. Troopers from Post 10 responded to the location of the traffic stop and began an investigation. Murphy Smith was then transported to Harlan ARH and subsequently transferred onto the UK Medical Center in Lexington.
Preliminary investigation indicates Murphy Smith (63) of Cumberland was at his brother’s residence when an altercation took place between the two. Murphy Smith received a single gunshot wound to the leg from his brother, Walter Smith (65) of Totz, during the altercation.
Murphy then left the scene toward the hospital when the Harlan City Police Chief stopped the vehicle. He was then transported by ambulance to Harlan County ARH for his injuries and then later sent by ambulance to University of Kentucky Medical Center.
On July 4, 2019 at 8:59 p.m Troopers from Post 10 located and arrest Walter Smith in Harlan Co. He is charged with assault 1st degree and will be lodged into the Harlan County Detention Center.
